How to Tell If You’re Going to Win Your Disability Case
Is there a way to tell if you’re gonna win your case for Social Security disability benefits? My name is Kaitlin Wildoner and I’m an attorney who focuses on helping individuals prove their disability so they can focus on getting better. Today, we’re going to talk about how to tell if you are going to win your disability case.
Social Security Listings – The “Blue Book”
First, sounds much easier than it is, but if you have a Social Security disability case and you meet one of the listings that are in the Blue Book, you should be found disabled. Some of the listings include amputations of certain limbs, liver transplantation, skin cancer, leukemia and breast cancer. Each listing has specific requirements that must be met and medical evidence that supports those requirements in order to be found disabled.
Supportive Records from Your Treating Doctors
Another way you might be able to predict that you’re going to win your disability case is if you have medical records from your doctor that say that you are unable to sustain a 40-hour work week on a continuing and ongoing basis. This is a bit difficult to be able to predict as Social Security will often review the totality of the evidence, and simply having one note from one doctor that says this is not likely to win your case by itself. However, it still can be very helpful.
What is a Bench Decision?
Third, if you have a hearing and the judge tells you that they are going to issue a bench decision, you can expect a favorable decision will be coming in the mail. However, I never, ever, ever count my favorable decision chickens before they hatch. You never know what can happen if your case gets pulled for quality review, so I often hold my breath until I see that favorable decision in black and white.
