How Much Does a Social Security Lawyer Cost?
If you are disabled and unable to work, you might be wondering if you can afford to hire an attorney to help you with your Social Security disability case. My name is Kaitlin Wildoner, and I’m an attorney who helps disabled clients obtain their disability benefits as quickly as possible so they can focus on getting better.
Today we’re going to talk about how much a Social Security disability lawyer costs. The first thing to note is that Social Security Disability attorney’s fees are regulated directly by the Social Security Administration (SSA). The fee permitted by SSA is currently 25% of any back-due benefits paid to you. The maximum fee caps out at $7,200 (as of November 30, 2022).
This means that for a full fee of $7,200 to be paid to your lawyer, your back-due benefits must total at least $28,800, of which you will receive $21,600 and the attorney would receive $7,200. If your back-due benefits are less than $28,800, the attorney will only charge 25% of your back-due benefits.
Additional Costs
In addition to the attorney’s fee, you might be responsible for reimbursing the attorney for costs. These can include the fees your doctors and hospitals charge for your medical records, postage, and other fees that they incurred while representing you.
Most attorneys discuss any significant costs with you before they incur them, so that way you have an understanding of what the total fees and costs are. While I can only speak for myself in my practice, it’s likely that you will have a basic idea of any excessive costs before the case ever resolves. While we don’t clear every medical record cost with you, we do work with you to keep that cost down, and we’ve even been able to resolve cases with no costs involved.
