When Does Congenital Zika Syndrome Qualify for Compassionate Allowance?

In this video, we’re going to discuss when Congenital Zika Syndrome can qualify for Social Security disability benefits through the compassionate allowance program. Congenital Zika Syndrome is a pattern of birth defects that are caused by an in utero infection of the fetal brain with the Zika virus. Social Security evaluates Congenital Zika Syndrome cases under several listings, including Listing 102.02 and Listing 112.14.
Because this is a childhood listing and compassionate allowance, the child’s parents must also meet the income and asset requirements for SSI. If not, at least one of the child’s parents must be disabled, retired, or deceased so the child can be eligible for SSDI benefits.
When reviewing medical records, Social Security will often be looking for: clinical history and examinations that describe the diagnostic features of the impairments. They will also look for positive Congenital Zika Syndrome-specific immunological testing, neuroimaging that will show microcephaly, and any type of hearing tests.
