If you were recently denied Social Security disability benefits (SSDI or SSI), you may be wondering what to do next.
My name is Kaitlin Wildoner and I’m an attorney who helps disabled clients obtain their disability benefits as quickly as possible so they can focus on getting better.
Today we’re going to answer a common question, what if my SSDI or SSI application is denied? If your Social Security disability application is denied, don’t panic! You have the right to appeal that denial.
The first step in the appeals process is filing a request for reconsideration. This involves asking the Social Security Administration to review your application again, along with any new information you may have and any new or missing medical records.
If your application is denied at the reconsideration level, the next step is to request a hearing before an administrative law judge. At the hearing, you will have the opportunity to present medical evidence and testify about your disability and why you believe you are entitled to Social Security disability benefits. It’s important to have a Social Security disability attorney representing you at that hearing as they can help prepare for your case and present your evidence in the most effective way. If the administrative law judge denies your claim, then you can file a request for review by the Appeals Council.
The Appeals Council May review the ALJ’s decision and may choose to overturn the decision, send it back for further review, or uphold the unfavorable decision. If the Appeals Council denies your claim or declines to review the ALJ decision, your final option is to file in a federal court.
It’s important to note that the appeals process can take a long time – sometimes several years. However, if you believe that you are disabled and unable to work in any capacity and you have doctors supporting you don’t give up!
