What to Do If Your SSI Application Was Denied
Did you recently receive a denial for your Supplemental Security Income (SSI) application and aren’t sure what to do next?
My name is Kaitlin Wildoner, and I’m an attorney who helps disabled clients obtain their disability benefits as quickly as possible so they can focus on getting better. Today, we’re going to discuss what you can do if your application for SSI benefits was denied.
Step 1: Review the Denial Letter
The first thing you should do is carefully read the denial letter from the Social Security Administration (SSA).
This letter outlines the reason(s) for denial, which may include:
- Insufficient medical evidence
- Failure to meet the disability criteria
- Exceeding income or asset limits
Understanding the SSA’s rationale is key to planning your next steps.
Step 2: Know the Deadlines
You typically have 60 days from the date on the denial letter, plus an additional five days for mailing, to file a reconsideration appeal.
⏳ If you miss this deadline, you may have to start over with a brand new application—so be mindful of the timeline.
Step 3: Request Reconsideration
The first level of appeal is called the reconsideration stage.
When submitting your request for reconsideration, be sure to:
- Include any new or updated medical records
- Provide a list of all medical providers you’ve seen, including doctors, hospitals, and clinics
- Submit test results and updated statements from your healthcare providers
This additional evidence can help strengthen your case.
Step 4: Request a Hearing (If Denied Again)
If your request for reconsideration is also denied, the next step is to request a hearing before an Administrative Law Judge (ALJ).
This hearing gives you the opportunity to present your case, offer testimony, and submit more detailed documentation to support your claim.
Step 5: Consider Speaking With a Disability Attorney
Working with a disability attorney who focuses on Social Security claims can be incredibly helpful.
An experienced attorney can:
- Review your denial and appeal
- Help gather the necessary documentation
- Provide strategic guidance
- Represent you during your hearing
Having an expert on your side can increase your chances of approval at the reconsideration or hearing stage.
