A Step-by-Step Guide to Navigating the Social Security Disability Process

Are you preparing to apply for Social Security Disability benefits? Understanding the process can make all the difference.

My name is Kaitlin Wildoner, and I’m an attorney who helps disabled clients obtain their disability benefits as quickly as possible so they can focus on getting better. Today, we are going to discuss the Social Security Disability process.

Step 1: Determining Your Eligibility

The first step in the Social Security Disability process is determining your eligibility.

You’ll want to review the eligibility criteria for both SSDI (Social Security Disability Insurance) and SSI (Supplemental Security Income) benefits to ensure that you meet those requirements.

This includes:

  • Having a qualifying disability
  • Earning sufficient work credits for SSDI
  • Meeting the limited income and resource requirements for SSI

Step 2: Gathering Documentation

You’ll want to collect all necessary documentation to support your disability claim.

This can include:

  • Medical records
  • Test results
  • Treatment history
  • Work history
  • Any other relevant evidence

If you cannot collect the medical records yourself, be sure to have a complete list of all of the providers you’ve seen for your conditions—including all doctors, clinics, and hospitals.

Step 3: Start the Application Process

You can complete the Social Security Disability application:

  • Online
  • By phone
  • Or in person at your local Social Security office

Be sure to provide accurate and detailed information about your conditions, your work history, and any other required information.

Step 4: Disability Determination Review

The Disability Determination Services within the Social Security Administration will review your medical condition and medical records to determine whether you meet the disability requirements.

This process may also include additional medical examinations or consultations.

Step 5: Initial Application Decision

You will receive a notice regarding the decision on your Social Security Disability application.

  • If approved, you will be informed of the amount of your benefits and when they will begin.
  • If denied, you can move to the appeals process, which is Step Six.

Step 6: Reconsideration Appeal

You can request reconsideration within 60 days plus five days for mailing after the date of your initial denial.

For the reconsideration appeal:

  • Submit any additional evidence that supports your case
  • Provide a written explanation of why you disagree with the initial decision

The explanation can be brief or extensive—whatever you feel best supports your position.

Step 7: Hearing Before an Administrative Law Judge

If your claim is denied at the reconsideration stage, the next step is a hearing before an administrative law judge.

At that time:

  • A judge will review your case
  • You will have an opportunity to present evidence and testimony to support your disability claim

Step 8: Appeals Council Review

If the administrative law judge denies your claim, you can request a review from the Social Security Administration’s Appeals Council.

The Appeals Council will review the judge’s decision to determine whether additional action is necessary.

Step 9: Federal Court Appeal

The final step in the Social Security Disability process is an appeal in federal court.
