What to Do If Your SSDI Application Was Denied
Did you recently receive a denial for your Social Security Disability Insurance (SSDI) application and aren’t sure what to do next?
My name is Kaitlin Wildoner, and I’m an attorney who helps disabled clients obtain their disability benefits as quickly as possible so they can focus on getting better. Today, we’re going to discuss the steps you can take if your SSDI application was denied.
Step 1: Review the Denial Letter Carefully
Start by reading the denial letter from the Social Security Administration (SSA) thoroughly.
Understand the specific reasons for the denial, which may include:
- Insufficient medical evidence
- Failure to meet disability criteria
- Technical errors in the application
This information will help guide your next steps.
Step 2: Understand the Deadlines
Timing is critical.
The deadline to file an appeal is generally 60 days from the date of the denial letter, plus an additional five days for mailing.
⏳ Missing this deadline may require you to start the entire application process over.
Step 3: File a Reconsideration Appeal
The first level of appeal is called a Request for Reconsideration.
To strengthen your appeal:
- Submit the reconsideration request within the deadline
- Include any new medical records, test results, and updated statements from your health care providers
🩺 If collecting these records is too difficult, make sure to provide the SSA with a complete list of your medical providers.
They will attempt to obtain the records on your behalf, but if they encounter issues, they may reach out to you for assistance.
Step 4: Request a Hearing If Denied Again
If your Request for Reconsideration is denied, the next step is to request a hearing before an Administrative Law Judge (ALJ).
This is your opportunity to present your case in person (or via video), submit additional evidence, and explain how your disability prevents you from working.
Step 5: Consult With a Disability Attorney
Finally, consider seeking help from a disability attorney who specializes in Social Security Disability claims.
An attorney can:
- Review your denial and evaluate the strengths and weaknesses of your case
- Help gather necessary documentation
- Represent you during the hearing
- Offer strategic guidance every step of the way
