Can You Receive Social Security Disability Benefits and VA Disability?

Have you ever wondered whether you may be eligible for Social Security disability benefits in addition to your VA disability benefits?

My name is Kaitlin Wildoner, and I’m an attorney who helps disabled clients obtain their disability benefits as quickly as possible so they can focus on getting better.

In today’s video, we will discuss Social Security Disability Benefits following military service.

Social Security Disability After Military Service

Disabled veterans may be eligible for Social Security disability benefits in addition to—or as an alternative to—VA disability compensation.

To qualify for SSI or SSDI, a veteran must meet the Social Security Administration’s definition of disability, which is different from the VA’s criteria.

Key Differences Between SSA and VA Disability Criteria

Under Social Security, to receive disability benefits:

  • The veteran must have a physical or mental impairment
  • That impairment must prevent them from engaging in substantial gainful activity (SGA), which is earning above a certain monthly amount
  • The disabling condition must have already lasted or be expected to last at least 12 months, or result in death

Unlike VA disability benefits, Social Security disability benefits:

  • Do not require that the disability be service-connected
  • Do not take into account the veteran’s discharge status
  • Use the same eligibility criteria for both veterans and non-veterans

Expedited Processing for Certain Veterans

The Social Security Administration offers expedited processing for certain veterans, including those with a:

  • 100% Permanent and Total disability rating from the VA

These individuals can have their Social Security disability applications expedited by identifying themselves as such during the application process.

Additional Benefits Beyond Monthly Payments

In addition to cash payments, Social Security disability recipients may also be eligible for:

  • Medicare or Medicaid health insurance,
    which can help to supplement VA health services

Apply for Both Programs Separately

It’s important to note that while the VA and the Social Security Administration disability programs have different criteria:

  • Veterans may be eligible for both, and
  • Should apply for each program separately

The Social Security Administration and the VA work cooperatively to:

  • Expedite processing, and
  • Share medical evidence when veterans apply for both programs
